PRIVACY POLICY

This privacy policy (“Privacy Policy”) establishes the terms on which the users (“You” or “Your”) Personal Information (as defined below) collected during the access and use of the website i.e. www.xenialevents.com and the software application (collectively referred to as the “Platform”) owned and operated by Xenial Events Sole Proprietorship  LLC having its registered office at 401, C34 Building, Khalifa Street,  PO Box: 94449, Abu Dhabi, United Arab Emirates (“Company” or “We” or “Us” or “Our”) is stored, collected, received, disclosed, transferred, processed, dealt with or otherwise handled by the Company.

Prior to accessing any material or information on the Platform or registering on it, please carefully read the Privacy Policy and the Terms of Use available at: https://www.xenialevents.com/terms-and-conditions. Your visit to the Platform or use of the Platform shall be deemed to mean that You have read and understood the Privacy Policy and You agree to be in compliance with and be bound by this Privacy Policy, which together with the Terms of Use shall control Your relationship with the Company. We reserve the right to amend or modify this Privacy Policy without notifying the same to You. You can determine the last amendment or modification made to this Privacy Policy by referring to the “Last Updated” legend above. Your continued use/access of the Platform signifies Your acceptance of any amendments and modifications.

This Privacy Policy does not apply to information that You provide to, or that is collected by, any third-party (except as otherwise provided herein) through the Platform and any information that we obtain about You otherwise than through the Platform.

COLLECTION OF INFORMATION

This Privacy Policy applies to information that:

You provide to Us voluntarily while using or registering on the Platform or contacting Us or sending Us a correspondence, such as name, mobile number, email address, WhatsApp number, gender, nationality, date of birth, spoken languages, place of residence, employment details, curriculum vitae. All information disclosed by You shall be deemed to be disclosed willingly and without any coercion. No liability pertaining to the authenticity of the information disclosed shall lie on the Company nor will the Company be in any way responsible to verify any information obtained from You. We may ask for additional information on case-to-case basis (“Personal Information”);

We may also collect certain non-personal information, such as Your internet protocol address, web request, operating system, browser type, URL, internet service provider, IP address, aggregate user data, browser type, software and hardware attributes, pages You request, how the page is rendering, user interactions such as mouse movements, click scrolls, and cookie information, etc. which will not identify with You specifically (“Non-Personal Information”), while You browse, access or use the Platform. We receive and store Non – Personal Information, by the use of data collection devices such as “cookies” on the Platform, in order to help and analyze Our Platform flow, track user trends, measure promotional effectiveness, and promote trust and safety. We place both permanent and temporary cookies in Your computer’s hard drive. You can block the cookies through the browser settings, however, that will prevent access to certain features of the Platform. In general, You can browse the Platform without telling Us who You are or revealing any Personal Information about Yourself. In such a case, we will only collect and store the Non-Personal Information. We may automatically track certain information about You based upon Your behaviour on the Platform. We use this information to do internal research on Your demographics, interests, and behaviour to better understand, protect and serve You. This information is compiled and analysed by the Company on an aggregated basis and not individually, in a manner that does not specifically identify You. If You choose to post messages on our message boards, chat rooms or other message areas or leave feedback, We will collect and store such information You provide to Us. We retain this information as necessary to resolve disputes, provide customer support, respond to queries and inquires, and troubleshoot problems and improve the services. If You send us correspondence, such as emails or letters, or if other users or third parties send us correspondence about Your activities or postings on the Platform, We may collect and retain such information into a file specific to You for responding to Your request and addressing concerns in relation to Your use of the Platform. We shall be entitled to retain Your Personal and Non-Personal Information for such duration as may be required for the purposes specified hereunder and will be used by Us only in accordance with this Privacy Policy.

USE OF YOUR INFORMATION

We use the Personal Information and other Non-Personal Information, for the following: (i) to contact You; (ii) to help promote a safe service on the Platform and protect the security and integrity of the Platform, the services and the users; (iii) to resolve disputes and troubleshoot problems;  (iv) to detect, prevent and protect Us from any errors, fraud and other criminal or prohibited activity on the Platform; (v) customize Your experience on the Platform or share marketing material with You; (vi) inform You about offers, products, services, and updates; (vii) enforce and inform about our terms and conditions; (viii) to process and fulfil Your request for services or collaboration or respond to Your comments and queries on the Platform; (ix) to communicate important notices or changes in the services provided by the Company, use of the Platform and the terms/policies which govern the relationship between You and the Company and with Our affiliates; (x) to allow Our business partners and/or associates to present customised messages to You; (xi) to provide and improve the services on the Platform; and (xii) for any other purpose after obtaining Your consent at the time of collection.

In addition to the above, We identify and use Your IP address to help diagnose problems with Our server, resolve such problems and administer the Platform. We use Your Personal Information to send You promotional emails, however, We will provide You the ability to unsubscribe from receiving such emails from Us.

We do not sell, trade or rent Your Personal Information to others. We may share generic aggregated demographic information not linked to Personal Information with our affiliates, partners and advertisers for the purposes as outlined under this Privacy Policy.

We post testimonials on our Platform, which includes the Personal Information of the users providing such testimonials and We obtain prior permission from such users before posting the testimonials on our Platform. We are not responsible for the Personal Information that such users elect to post with the testimonials.

SHARING OF INFORMATION

We may disclose Your Personal Information and Non-Personal Information to third party vendors, consultants, and other service providers who work for the Company, who are bound by contractual obligations to keep such Personal Information and Non-Personal Information confidential and use it only for the purposes for which We disclose it to them. This disclosure may be required for Us, for instance to facilitate and assist Our marketing and advertising activities/initiatives, for undertaking auditing or data analysis, tracking User behaviour or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to Our services or to respond to Your queries and messages. We may also make Your Personal Information and/or other Non-Personal Information available to third-party service providers and Our affiliates to enable them to provide services to You and on need-to-know basis. We may also make Your Personal Information and/or other Non-Personal Information available to third-party event organizers to enable them to procure Your services. Please note that all information shared with Our affiliates or made available to Our affiliates will be governed by the terms of this Privacy Policy. We do not disclose Your Personal Information to third parties for their marketing and advertising purposes without Your explicit consent. We and Our affiliates may, in compliance with applicable laws, share/transfer/assign all of Your Personal Information and other information with any other business entit(ies), in the event of a merger, sale, re-organization, amalgamation, joint ventures, assignment, restructuring of business or transfer or disposition of all or any portion of Our business. However, We shall not be responsible for any information including Personal Information collected or shared or used by any other third -parties due to Your browser settings. Further, under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or members may abuse or misuse Your information that they collect from the Platform and while We use the industry standard practices for ensuring safety and security of Your Personal Information, We shall not be held responsible for such unlawful actions.

LINKS TO OTHER THIRD-PARTY SITES AND COLLECTION OF INFORMATION

Our Platform may link You to other third-party websites (“Third-Party Sites”) that may collect Your Personal Information and Non-Personal Information including Your IP address, browser specification, or operating system. The Company is not in any manner responsible for the security of such information or their privacy practices or content of those Third-Party Sites. Additionally, You may also encounter “cookies” or other similar devices on certain pages of the Third-Party Sites and it is hereby clarified by the Company that the Platform does not control the use of cookies by these Third-Party Sites. These third-party service providers and Third-Party Sites may have their own privacy policies governing the storage and retention of Your information that You may be subject to. This Privacy Policy does not govern any information provided to, stored on, or used by these third-party providers and Third-Party Sites. We recommend that when You enter a Third-Party Site, You review the Third-Party Site’s privacy policy as it relates to safeguarding of Your information.

SECURITY PRECAUTIONS AND MEASURES

Our Platform has reasonable security measures and safeguards in place to protect Your Personal and Non-Personal Information from loss, misuse, unauthorized access, disclosure, destruction, and alteration. We cannot however ensure or warrant the security of the information You transmit to the Company or guarantee that Your Personal Information and/or other Non-Personal Information provided while using or registering on the Platform may not be accessed, disclosed, altered or destroyed by a breach of any of Our security measures and safeguards. It is further clarified that You have and so long as You access and/or use the Platform (directly or indirectly) the obligation to ensure that You shall at all times, take adequate physical, managerial, and technical safeguards, at Your end, to preserve the integrity and security of Your data which shall include and not be limited to Your Personal and Non-Personal Information. The Company assumes no liability or responsibility for disclosure of Your information due to errors in transmission, unauthorized third-party access, or other causes beyond its control.

PROCESSING WITHOUT YOUR CONSENT:

You agree and understand that We may process Your Personal and Non-Personal Information without Your consent in the following cases:

1. Necessary for the performance of the contract to which You are a party or to take measures at Your request with a view to entering into, amending or terminating a contract;
2. Necessary to protect the public interest and as may be directed by any statutory authorities;
3. Necessary for fulfilment of the obligations and exercise of the legally established rights in the field of employment, social security or laws related to social protection to the extent permitted by those laws;
4. Necessary for the establishment or defence of any legal rights and claims, or in connection with judicial or security proceedings;
5. Is related to Personal and Non-Personal Information that has become available and known to everyone through Your act;
6. Necessary to protect Your interests;
7. Necessary to carry out obligations specified in other laws in UAE.

FOR HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

The Personal and Non-Personal Information collected hereunder shall be preserved for as long as (i) needed or permitted for the purpose for which it was obtained; (ii) required for compliance with legal obligations; (iii) the judicial action (if any, is initiated) ends, including potential appeal periods. The aforesaid storage shall at all times be in compliance with the applicable laws.     

WHAT ARE THE RIGHTS AVAILABLE TO YOU?

You shall be entitled to the following rights with respect to Your Personal Information, subject to the applicable laws:

1. Right to receive Personal Information shared with us in a structured and machine-readable format and request transfer of Personal Information to another entity, wherever possible;
2. Right to obtain information such as type of Personal Information processed, purposes for processing and establishments with which such Personal Information shall be shared;
3. Right to have the Personal Information corrected (in case of inaccuracy or incompleteness) or erased;
4. Right to object to automated processing;
5. Right to object processing in the following cases: (i) where processing is for the purpose of conducting statistical surveys (unless necessary to achieve the public interest) or is in violation of applicable laws; (ii) where processing is for direct marketing purposes including profiling; (iii) if treatment is violation of Article (5) of Federal Decree Law No. 45 of 2021; (iv) where You contest the accuracy of the Personal Information; and (v) where processing is in contradiction of the agreed purposes.

Further, If You have consented to the collection, use and/or disclosure of Your Personal Information as identified in the Privacy Policy, You may withdraw the same by communicating to Us, in writing, at the email address mentioned in the Grievance Redressal Mechanism below.

GOVERNING LAW:

This Privacy Policy shall be governed and construed in accordance with the laws of United Arab Emirates and all disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the Dubai Courts.

‍SEVERABILITY:

If, for any reason, a court of competent jurisdiction finds any provision of this Privacy Policy, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Privacy Policy shall continue in full force and effect.
